Consumer Health Data Privacy Policy
How WellSaid AI handles consumer health data under the Washington My Health My Data Act.
About This Policy
This Consumer Health Data Privacy Policy (“Policy”) is maintained by WellSaid AI, LLC (“WellSaid AI,” “we,” “us,” or “our”) in accordance with the Washington My Health My Data Act, RCW 19.373 (“MHMDA”). It applies to “consumer health data”—information that identifies a consumer's past, present, or future physical or mental health status and is linked or reasonably linkable to that consumer—that we collect from consumers who are Washington residents, or whose consumer health data is collected in Washington State, through our website (www.wellsaid.ai), our cognitive assessment platform, our AI companion (“Coach Cara”), and related services (collectively, the “Services”).
This Policy is separate and stand-alone. It governs our handling of consumer health data and controls over any other WellSaid AI privacy notice with respect to consumer health data. This Policy does not describe all of our data practices with respect to personal information generally; for that information, see our general Privacy Policy.
1.Categories of Consumer Health Data We Collect and Why
- Cognitive and physical health status information: responses you provide during our cognitive assessment (including memory, attention, language, and other cognitive-function exercises), self-reported symptoms, and information you share with Coach Cara about your physical or mental health. Collected and used to deliver the assessment, generate your report, and provide Coach Cara's personalized suggestions.
- Health history information: self-reported personal and family health history (such as history of dementia, cognitive decline, or related conditions), and known genetic or lifestyle risk factors you choose to share. Collected and used to inform your assessment, your specialist's review, and your report.
- Health-related inferences: inferences we or a reviewing healthcare professional derive from your assessment responses and other consumer health data about your cognitive function or health status. Used to prepare your personalized report and recommendations.
- Precise location information, where applicable: if you enable location services, general or precise location associated with your use of the Services. Used for account security and fraud prevention.
- Health-related purchasing information: your purchase of the cognitive assessment or related products, which may reveal an attempt to seek health services. Used to process your order and provide the Services you requested.
2.Sources of Consumer Health Data
We collect consumer health data from the following categories of sources:
- Directly from you, when you complete the cognitive assessment, communicate with Coach Cara, or otherwise provide information through the Services.
- From the healthcare professional who reviews your assessment, in the form of review notes, scoring, and recommendations.
- Automatically, through your use of the Services, such as precise location where enabled.
3.Categories of Consumer Health Data We Share
We share the following categories of consumer health data solely for the purposes described in Sections 1 and 4:
- Cognitive and physical health status information.
- Health history information.
- Health-related inferences.
We do not sell consumer health data, and we do not share consumer health data for advertising purposes.
4.Categories of Third Parties and Specific Affiliates
We share the categories of consumer health data listed in Section 3 with the following categories of third parties, each acting as our service provider under a written contract limiting their use of consumer health data to providing services to us:
- Healthcare professionals engaged by us to review assessment responses and prepare reports.
- Cloud hosting and data storage providers.
- Customer support service providers.
- Identity verification and fraud-prevention providers.
- Artificial intelligence service providers that support Coach Cara's personalized suggestions.
Specific affiliates: We do not share consumer health data with any affiliated companies.
5.Your Rights
If you are a Washington consumer, you have the right to:
- Confirm whether we are collecting, sharing, or selling your consumer health data, and access that data.
- Withdraw consent to our collection or sharing of your consumer health data.
- Request deletion of your consumer health data. Upon a valid request, we will delete your consumer health data from our records, including archived or backup systems, and direct any service providers who received it from us to do the same.
We do not sell consumer health data and therefore there is no authorization to withdraw with respect to sale.
How to Exercise These Rights
Submit a request by emailing support@wellsaid.ai with the subject line “Washington Consumer Health Data Request,” or by writing to WellSaid AI, LLC, 1001 Green Bay Road, #215, Winnetka, IL 60093-1721.
If you have an existing account, we may ask you to submit your request through your account to verify your identity; we will not require you to create a new account to submit a request. If we cannot reasonably verify your identity, we may request additional information or decline the request.
We will respond within 45 days of receipt, with one possible 45-day extension where necessary. If an extension is needed, we will notify you before the initial 45-day period expires. There is no fee to submit a request.
Appeals
You may appeal a denied request by replying to our response with “Appeal” in the subject line. We will respond to any appeal within 45 days.
6.Changes to This Policy
If we intend to collect, use, or share new categories of consumer health data, or use consumer health data for new purposes not disclosed in this Policy, we will update this Policy and obtain your affirmative, opt-in consent before doing so, as required by the MHMDA.
